FAQ
Straight answers, no jargon
Short, direct answers to the questions I hear most. If yours isn't here, ask me directly, there's no charge for the conversation.
How much compensation can I get for a personal injury claim?
It depends on your injury, its impact on your income and daily life, and the circumstances of the incident. There's no fixed figure or calculator that gives a reliable answer. I can give you a realistic sense of where your claim sits once I've reviewed the details.
How long do I have to make a claim in Queensland?
Timelines vary depending on the type of claim, and some early steps have their own strict, shorter deadlines. But the key rule to know is the common law limitation period: you generally have 3 years from the date of injury to start a court proceeding. Don't wait to check your specific timeframe, contact me as soon as possible.
What does "no win, no fee" mean?
You pay nothing upfront, and nothing at all if the claim doesn't succeed. The full arrangement is set out plainly in a costs agreement before you commit to anything.
Do I have a claim if the accident was partly my fault?
Possibly. Queensland law allows for contributory negligence, meaning your compensation may be reduced rather than eliminated if you were partly at fault. It's worth having the specifics reviewed rather than assuming you have no claim.
What happens if the other driver was unregistered or uninsured?
You may still be able to claim. Queensland has a fund that can cover injuries caused by unidentified, unregistered or uninsured vehicles in certain circumstances. Take down whatever details you can from the scene (vehicle description, plate, location, witnesses) and get advice early.
My WorkCover claim was rejected. Is that the end of it?
No. A rejected WorkCover claim can often be reviewed or appealed. Many rejections are overturned once the medical evidence and incident details are properly presented. Get in touch and I'll review the reasons given for the rejection.
Can I claim TPD if I'm still working reduced hours?
It depends on your super fund's specific definition of total and permanent disability: some policies require you to be completely unable to work in any occupation, others use a narrower test tied to your own occupation. This is worth having reviewed against your actual policy wording.
How much does it cost to find out if I have a claim?
Nothing. The initial conversation is free and carries no obligation to proceed.
Will my case go to court?
Most personal injury, TPD and WorkCover claims settle through negotiation without reaching a courtroom. Litigation is possible if a fair settlement can't be reached, and I'll always explain the likelihood of that before it happens.
I've already started a claim myself. Can you take over?
Yes. I regularly pick up claims that were self-lodged or handled by another firm, including ones that were rejected or seem to have stalled.
